OverviewFraud lives in records most lawyers never ask for.

Proving immigration fraud rarely turns on a confession — it turns on circumstantial evidence and the federal immigration records that reveal what really happened. The Discovery Package gives your local counsel a customized set of written discovery built from our federal immigration analysis, so the case develops that record without local counsel having to master immigration law.

Deliverables
Interrogatories, RFP, RFAs, Subpoenas, Deposition Prep
Timeline
Typically 2–4 weeks after the assessment
Value
Secures evidence that may otherwise be missed.

You must retain local counsel. A completed Fraud Assessment is also required — the package is custom-built around what it identifies. Codias Law provides drafts only; your local counsel serves and manages the discovery under state procedure.

The ContextsDiscovery for four kinds of cases.

The Discovery Package is custom-built for four litigation contexts. The instruments differ; the federal immigration-law analysis that drives them does not.

The Case ArcFrom investigation to assessment to discovery.

Each phase plays a distinct role: the investigation builds the factual foundation, the Fraud Assessment delivers the legal conclusions, and the Discovery Package converts both into the written instruments local counsel serves.

The ProcessHow a Codias Law discovery package works.

01

Fraud Investigation

Our fraud investigations establish the factual foundation. We collect and authenticate evidence, conduct independent research, and when appropriate interview witnesses and coordinate forensic analyses. The result is a verified timeline and witness dossiers.

02

Fraud Assessment

Our fraud assessments provide a formal legal opinion on whether immigration fraud is in play. We apply federal immigration law to the verified facts and deliver a clear roadmap of what the discovery should pursue.

03

Facts to Establish

From the investigation and assessment, we identify the specific facts that matter most to prove the fraud — the elements local counsel needs to put on the record.

04

Identify Vehicles

In coordination with your local counsel, we determine which discovery vehicles fit the case posture — interrogatories, requests for production, requests for admission, subpoenas, depositions, or some combination.

05

Draft Discovery

We draft the customized discovery package, with the immigration-law analysis behind each request, scoped to the facts to establish and the vehicles identified.

06

Handoff

We deliver the package and brief your local counsel on the theory of the case. Local counsel conforms the requests to local court rules, serves them, and manages the discovery process under state procedure.

Why Codias Law?Why local counsel may want our help.

Local counsel can serve discovery — but without immigration experience, they cannot reliably target what proves immigration fraud. Here is what we bring to the package.

  • We know immigration law.

Federal statutes, regulations, BIA precedent, and USCIS practice — we know what records exist, what they show, and how to compel them. Local counsel without immigration experience does not.

  • We know the fraud patterns.

VAWA self-petitions, U visas, I-751 waivers, T visas — we know the recognized fraud factors and the schemes used to manufacture them. Discovery targets the evidence that proves the pattern.

  • We do this work all the time.

Immigration-fraud discovery is recurring work for us. Local counsel doing it for the first time would spend months learning the federal layer; we arrive with it already built in.

FAQs

Who is responsible for discovery?
Local counsel. Your retained local counsel is exclusively responsible for serving and managing discovery — advising on state civil procedure, conforming the requests to local court rules, formally serving them, and handling responses, motions, and disputes. We provide the drafts and the immigration-law analysis behind them.
What is discovery in litigation?
The formal exchange of evidence. Discovery is the pre-trial process by which parties obtain evidence from each other and from third parties — through interrogatories, requests for production, requests for admission, subpoenas, and depositions. In immigration-fraud cases, discovery is where the federal record gets pulled into the state-court matter.
When do we get involved?
After the Fraud Assessment. A completed Fraud Assessment is required before the discovery package is prepared — the requests are custom-built around the specific vulnerabilities the assessment identifies. Once the assessment is complete and the client engages us for the discovery package, we deliver in 2–4 weeks.
How do we help with discovery?
By drafting the package. We draft the customized set of interrogatories, RFPs, RFAs, subpoenas, and deposition prep — built from the fraud theory the assessment identified — and deliver it with the immigration-law analysis behind each request. Local counsel serves and manages.
Why do we help local counsel?
Because immigration-fraud discovery requires federal expertise. Local counsel can serve discovery, but without federal immigration experience cannot reliably target what proves immigration fraud. We bring the federal layer; they bring the state procedure.
